KinPeto is not responsible for delivery problems caused by inaccurate or incomplete information supplied by the customer, except where applicable law provides otherwise.

11. PAYMENT

We accept payment methods made available at checkout.

Payment must be successfully authorized before an order is processed unless we expressly offer another payment method.

We do not knowingly retain complete payment-card information where the payment provider processes that information on our behalf.

Payment processing may be subject to the terms and privacy practices of the relevant payment provider.

12. CASH ON DELIVERY

Where Cash on Delivery ("COD") is offered, availability may depend on:

remote-area delivery;

We will not represent a delivery timeframe unless we have a reasonable basis for doing so.

For U.S. orders, applicable federal requirements concerning shipping representations and delayed shipments will be respected.

14. INTERNATIONAL ORDERS

KinPeto may offer delivery to countries outside India.

International customers are responsible for reviewing:

estimated delivery periods;
applicable customs requirements;
import restrictions;
duties;
taxes;
brokerage or clearance charges; and
other charges imposed by the destination country.

Unless expressly stated otherwise at checkout, customs duties, import taxes, and similar destination-country charges may be the customer's responsibility.

We do not control customs authorities and cannot guarantee that an order will clear customs within a particular period.

Nothing in this section transfers to the customer any charge that applicable law requires KinPeto to bear.

15. CUSTOMS AND IMPORT RESTRICTIONS

Customers ordering internationally are responsible for complying with applicable import laws.

If a shipment is refused, seized, delayed, returned, or destroyed because of destination-country restrictions, inaccurate customer information, or failure to pay legally applicable import charges, available remedies will be determined under the applicable law and our Shipping & Delivery and Returns & Refund Policies.

KinPeto will not knowingly ship products where doing so would violate applicable law.

16. ORDER CANCELLATION

You may request cancellation of an order by contacting KinPeto as soon as possible.

Cancellation requests made before fulfillment may generally be easier to process, but an order may already have entered processing or shipment.

Nothing in this section limits a customer's statutory right to cancel, withdraw, or otherwise terminate an order where such right applies.

17. RETURNS AND REFUNDS

Returns and refunds are governed by the KinPeto Returns & Refund Policy, which forms part of these Terms.

That policy explains:

eligible returns;
damaged or defective products;
incorrect products;
return procedures;
refund procedures;
cancellation rights;
return shipping;
non-returnable products where legally permitted; and
applicable international consumer rights.

Where the Returns & Refund Policy conflicts with a mandatory consumer right, the mandatory legal right will prevail.

18. EU / EEA CONSUMER WITHDRAWAL RIGHTS

Where EU/EEA consumer law applies, eligible consumers generally have a statutory right to withdraw from qualifying distance contracts within 14 days, generally beginning when the consumer or another designated person receives the goods.

Certain statutory exceptions apply, including for specified personalized goods, certain sealed goods opened for hygiene reasons, and other categories recognized by law.

Where a valid withdrawal is exercised, applicable EU/EEA rules may require reimbursement of payments and standard delivery costs, subject to the conditions and exceptions established by law.

Nothing in these Terms is intended to waive or restrict mandatory EU/EEA consumer rights.

19. UK CONSUMER CANCELLATION RIGHTS

Where UK consumer law applies, eligible customers purchasing qualifying goods through distance selling generally have a statutory cancellation period of 14 days after receiving the goods, subject to applicable exceptions and legal requirements. Customers generally have an additional period to return goods after notifying the seller of cancellation.

The applicable statutory rules may also require reimbursement of standard delivery charges and impose specific refund timing requirements.

Nothing in these Terms is intended to waive or restrict mandatory UK consumer rights.

20. DEFECTIVE, DAMAGED, OR INCORRECT PRODUCTS

otherwise not as required by applicable consumer law,

please contact KinPeto promptly with your order number and, where reasonably requested, photographs or other evidence.

We will assess the issue and provide the remedy required by applicable law and our Returns & Refund Policy.

Depending on the circumstances and applicable law, remedies may include:

replacement;
repair;
refund;
price reduction; or
another legally required remedy.

Mandatory legal remedies take priority over any voluntary store policy.

21. PRODUCT SAFETY AND INTENDED USE

Products should be used according to their instructions, warnings, specifications, and intended purpose.

Customers should exercise reasonable care when using pet products and should supervise pets where appropriate.

KinPeto does not represent that every product is appropriate for every animal, breed, size, age, medical condition, or circumstance.

Where a product contains specific safety instructions or warnings, customers should follow them.

Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded.

22. DROPSHIPPING AND THIRD-PARTY FULFILLMENT

KinPeto may use third-party manufacturers, suppliers, warehouses, logistics companies, payment processors, and fulfillment providers.

Some orders may be shipped directly from a supplier or fulfillment facility to the customer.

This may result in:

different packaging;
supplier or fulfillment-center markings;
different shipping origins;
separate shipments for products in the same order;
different tracking information; or
reasonable differences in packaging materials.

Use of third-party fulfillment providers does not remove KinPeto's responsibilities to customers under applicable law.

23. PRODUCT SUPPLIERS AND MANUFACTURERS

Where permitted by law, KinPeto may source products from third-party manufacturers and suppliers.

Product manufacturers may provide their own instructions, specifications, warranties, or safety information.

Nothing in this section transfers KinPeto's own legal obligations to the customer where KinPeto is legally responsible as the seller.

24. PROMOTIONS AND DISCOUNTS

Promotional offers may be subject to additional terms.

Unless expressly stated otherwise:

promotions cannot be combined;
promotional codes must be used before expiration;
discounts cannot be applied retroactively;
promotions may be limited by product or customer;
promotions may be subject to stock availability.

Where required by law, promotional terms will be disclosed clearly.

We will not withdraw or modify a promotion in a way that unlawfully defeats rights already acquired by a customer.

25. REVIEWS, FEEDBACK, AND USER CONTENT

it is not fraudulent or misleading;

You retain ownership of your User Content.

KinPeto may moderate or remove User Content that violates these Terms or applicable law.

We do not require customers to give up legally protected rights relating to honest reviews.

KinPeto may investigate transactions that reasonably appear fraudulent, abusive, or unauthorized.

Where permitted by law, we may suspend or cancel suspicious transactions and take appropriate measures to protect customers and the business.

Where an order is cancelled after payment, any refund required by applicable law will be provided.

We will not use fraud-prevention measures as a basis to unlawfully deny statutory consumer rights.

39. GOVERNING LAW

These Terms are governed primarily by the laws of India, without giving effect to conflict-of-law principles that would require another law to apply.

However, this governing-law provision does not exclude or override mandatory consumer-protection laws that apply to you in your place of residence or in connection with the transaction.

If the law of your jurisdiction gives you rights that cannot legally be waived by contract, those rights remain available to you.

No Mandatory Arbitration

KinPeto does not require consumers to submit disputes to mandatory binding arbitration as a condition of purchasing products from us.

Nothing in these Terms prevents a customer from using any court, consumer commission, regulator, statutory complaint process, mediation process, or other dispute-resolution mechanism available under applicable law.

Where mandatory law provides a particular forum, remedy, or dispute-resolution mechanism, that legal requirement will prevail.

41. COURTS AND JURISDICTION

Subject to mandatory consumer-protection laws, courts having jurisdiction under applicable Indian law may have jurisdiction over disputes concerning KinPeto.

However, nothing in this clause prevents a consumer from bringing a claim before a court, consumer tribunal, regulator, or other legally competent forum where mandatory law gives the consumer that right.

This clause should not be interpreted as requiring a consumer to travel to India where applicable law provides the consumer with a different mandatory forum.

42. STATUTORY CONSUMER RIGHTS

Nothing in these Terms is intended to:

exclude statutory consumer rights;
waive mandatory guarantees;
restrict legally required cancellation rights;
eliminate legally required refunds;
restrict mandatory product-safety rights;
prevent a customer from contacting a regulator or consumer authority;
prevent a customer from bringing a lawful claim; or
otherwise deprive a consumer of rights that cannot legally be waived.

If any provision of these Terms conflicts with a mandatory consumer-protection requirement, the mandatory requirement will prevail to the extent of the conflict.

43. INDIA-SPECIFIC CONSUMER PROTECTION

For customers in India, KinPeto intends to operate in accordance with applicable Indian consumer-protection and ecommerce requirements, including applicable provisions of the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020, as amended from time to time. The Department of Consumer Affairs identifies these rules as part of India's consumer-protection framework for ecommerce.

Nothing in these Terms limits rights available under applicable Indian law.

Customers may contact KinPeto using the contact details stated in these Terms regarding complaints, orders, refunds, delivery issues, or other concerns.

44. UNITED STATES CUSTOMERS

For customers in the United States, applicable federal and state consumer-protection laws may apply depending on the transaction and customer's location.

Nothing in these Terms is intended to waive rights that cannot legally be waived under applicable U.S. federal or state law.

Where applicable U.S. law imposes requirements concerning shipping representations, delays, cancellations, refunds, product safety, advertising, reviews, or consumer transactions, KinPeto will comply with those requirements to the extent applicable.

45. CANADIAN CUSTOMERS

For customers in Canada, consumer-protection rules may vary by province or territory.

Canadian consumer protection is substantially governed by provincial and territorial legislation, in addition to applicable federal requirements.

Nothing in these Terms is intended to remove or restrict mandatory rights provided by applicable Canadian law.

Where a provincial or territorial law gives a customer mandatory rights concerning contracts, refunds, cancellations, disclosures, warranties, or remedies, those rights will prevail over any inconsistent provision of these Terms.

46. EU/EEA AND UK CUSTOMERS

Where KinPeto accepts an order from a customer protected by applicable EU/EEA or UK consumer law, the applicable mandatory consumer rights will apply.

This includes, where applicable:

statutory withdrawal or cancellation rights;
statutory remedies for defective products;
required disclosures;
delivery protections;
refund requirements;
product guarantees; and
other mandatory consumer protections.

EU law generally provides eligible consumers with a 14-day withdrawal period for qualifying online purchases, while UK distance-selling rules generally provide a 14-day cancellation period for qualifying purchases.

47. INTERNATIONAL CUSTOMERS

Customers outside India, the United States, Canada, the EU/EEA, and the UK may have additional mandatory consumer rights under the laws of their country or region.

KinPeto does not intend these Terms to exclude rights that cannot legally be excluded.

Where local mandatory law conflicts with these Terms, the mandatory local law will apply to the extent required.

48. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be modified or limited to the minimum extent necessary to make it enforceable where legally permitted.

The remaining provisions will continue in effect.

49. NO WAIVER

If KinPeto does not immediately enforce a provision of these Terms, that does not constitute a permanent waiver of that provision.

Any waiver must be interpreted narrowly and will not automatically apply to future circumstances.

50. ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent, except where applicable law permits otherwise.

KinPeto may transfer or assign its rights and obligations as part of a legitimate business transaction, restructuring, merger, acquisition, or sale of assets, subject to applicable law and any required customer protections.

51. ENTIRE AGREEMENT

These Terms, together with the policies and documents expressly incorporated into them, form the agreement governing your use of the KinPeto website and purchases from KinPeto.
